EPA WaterSense Acknowledges the Water Efficiency of Waterfree Urinals

Los Angeles, CA. December 11, 2012. Falcon Waterfree Technologies announced today that the United States Environmental Protection Agency (EPA) has determined that waterfree urinals – such as those manufactured by Falcon Waterfree Technologies — should be considered equally eligible as all other WaterSense labeled products for participation in water conservation guidelines, specifications, and purchasing guidelines.

Under the WaterSense program, eligible products such as low flow urinals and toilets are evaluated and can receive a WaterSense label to differentiate them as using less water than other products in the same category. However, the EPA WaterSense program lacks a separate category for non-water using products like waterless urinals that completely eliminate water usage. To remove any confusion on the topic, the EPA acknowledges that “waterless urinals by design, are inherently water efficient” and should be considered as “equally eligible” as WaterSense labeled products for inclusion in water conservation incentives, rebates, purchasing decisions, and building specifications.

In a 2011 memorandum to WaterSense program partners, James A. Hanlon, former EPA Director of Wastewater Management, wrote that “EPA recognizes that non-water urinals which meet the applicable ANSI and ASME standards are inherently water-efficient. Decision-makers should consider including non-water urinals as equally eligible for the same rebates, tax incentives, procurement guidelines, and other conservation incentives as WaterSense labeled products.”

“Water districts, cities and agencies across America use the EPA WaterSense program as a guide to determine what products are included in water conservation incentive programs”, said Richard Sang, Director of Government Relations for Falcon Waterfree Technologies. “When a consumer decides to install a high efficiency urinal, they should know that waterless urinals such as Falcon Waterfree urinals are the most efficient water-saving choice,” Sang added.

Falcon Waterfree Technologies is an industry leader in gaining plumbing code approval and initiating water conservation programs aimed at replacing inefficient, water-guzzling flush urinals that waste billions of gallons of fresh water daily. Court Stops Sales of Liquidbreaker’s ‘Green Cartridge’ Citing “Unlawful Business Practices”; Liquidbreaker now in Bankruptcy.

Court cites the “possibility of harm” from using Green Cartridge that is “not in compliance” with Plumbing Codes.

Los Angeles, CA. December 3, 2012. After presentation of voluminous evidence, full written briefs, and oral arguments, the California Superior Court in San Diego County recently enjoined Liquidbreaker LLC “from promoting, offering for sale, selling, distributing or installing” Liquidbreaker’s Green Cartridge that it sells for use in Sloan® and Falcon Waterfree® urinals.

The Court also enjoined Liquidbreaker from causing any third party to “promote, offer for sale, sell, distribute or install” the Green Cartridge into Sloan® and Falcon Waterfree® urinals.

A related Court ruling noted the Liquidbreaker’s ‘Green Cartridge’“does not have a 2” liquid seal and it relies on a forbidden form of mechanical trap (which can fail) to prevent sewer gases from escaping… The absence of the required liquid seal and the use of a mechanical trap are both factors that increase the risk that the Liquidbreaker cartridge will fail and allow sewer gases to leak into the restroom… Defendants [Liquidbreaker] are marketing and selling a product that does not comply with the law and are therefore engaged in unlawful business practices”. The Court found that Falcon established a high probability of success on its claim that the sale of Liquidbreaker’s ‘Green Cartridge’ failed to comply with California laws.

Falcon Waterfree Technologies – the world’s largest manufacturer of waterless urinals – commenced the legal action because it saw that Liquidbreaker’s‘Green Cartridge’put the public at multiple risks due to the product’s non-compliance with plumbing code requirements. Falcon’s lawsuit sought an injunction based upon Liquidbreaker’s deceptive practices in marketing its ‘Green Cartridge’ for use in Falcon® and Falcon-licensed waterless urinals.

All waterless urinal cartridges that Falcon Waterfree manufactures are patented and certified to comply with the standards of the Uniform Plumbing Code (UPC), International Plumbing Code (IPC), and National Standard Plumbing Code (NSPC). While Falcon’s cartridges are IAPMO-certified as UPC compliant, IAPMO representatives testified that Liquidbreaker’s‘Green Cartridge’ lacks a two inch (2”) liquid trap design (as required by plumbing codes throughout America) and is non-compliant with the UPC. The California Court determined that the ‘Green Cartridge’ violates relevant plumbing code provisions.

“Liquidbreaker deceptively marketed its cartridges as compliant and safe replacement cartridges for Falcon-branded and Falcon-licensed waterless urinals, but the ‘Green Cartridge’ violates plumbing code requirements designed to protect the public health,” said Simon A. Davis, President & CEO of Falcon. “Falcon is committed to its customer’s health and safety and actively pursued this action against Liquidbreaker in order to prevent public health and safety risks.”

“Facility owners and managers should be alert to the Court’s injunction, to Liquidbreaker’s bankruptcy, and to the significant risks associated with using the ‘Green Cartridge’”, Davis noted.

The California Superior Court action is Falcon Waterfree Technologies vs. Giovanni Fima & Liquidbreaker(Case# 37-2012-00053834-CU-BT).

Bard College Goes Greener with Waterfree Urinals

LOS ANGELES, November 6, 2012 – Falcon Waterfree Technologies LLC announced today that Bard College replaced its flushing urinals with Falcon Waterfree urinals. The urinals will help Bard College’s sustainability efforts by saving over 500,000 gallons of water a year or more. This water savings will increase Bard’s STARS (Sustainability Tracking, Assessment & Rating System) score that measures how environmentally friendly a college or university campus is.

“Along with upgrades to our water treatment plant, the waterfree urinals will help us save a significant amount of water,” said Laurie Husted, Sustainability Manager at Bard College.

With the change from traditional flush urinals to waterfree urinals, the maintenance staff was at first concerned. However, after training, maintenance staff agreed that waterfree urinal maintenance was actually easier than flush urinal maintenance.

“Initially there was push back, probably because they feared the unknown, but that ended once we trained all staff. They realized that waterfree urinals actually are easier to clean than a regular flush urinal,” said Brian Kiel, Assistant Director of Environmental Services.

According to Bard College Lead Plumber Bruce Meyers, “We are already finding that cartridge changes are not needed as frequently as we first thought. No odor, no slow draining, no complaints. It’s a much better product than the flush urinals we had.”

In an effort to promote educational institutions’ water conservation, Falcon is partnering with colleges across the country to help them implement water saving solutions.

“Bard College continues to be a leader on green issues in academe, in this case by implementing sustainable solutions to preserve one of our most precious resources: water,” said Bard College President Leon Botstein.

“Partnering with Bard College was a natural fit for us because the school has already done so much to preserve our environment,” said Marc Nathanson, Chairman of Falcon. “We’re proud to support Bard, which will lead the way for other academic institutions to stop wasting the planet’s most precious resource: fresh water!”

In addition to offering several academic programs in sustainability, Bard College is also working on implementing sustainable practices on campus by focusing on efficient transportation, flow of goods and energy use. Some of the initiatives currently in place include reducing deliveries of bottled water, recycling waste, operating a free campus shuttle and participating in a car sharing service (Zipcar) that enables students to avoid car ownership.

Corona, a world class manufacturer of sanitaryware, has announced a joint commercial agreement with Falcon Waterfree Technologies, the world’s leading manufacturer of waterless urinal technology, to produce and distribute porcelain waterless urinals.

Under this agreement, Corona will increase their product portfolio to include several models of waterless urinals. These new additions will align with Corona’s initiatives to offer water conserving devices targeted to architects, contractors and end users who seek to reduce water consumption in retrofit and new construction.

Local Government’s Incentive Program Using Waterless Urinals Seen as Model

Sonoma County Water Agency’s award-winning High Efficiency Plumbing Fixture Direct Install Program that includes free installation of waterless urinals to its customers is a model on how private and public partnerships can benefit the local community, the economy and the environment.
“The program offers financial benefits to both the customers and contractors so we’re confident we’ll repeat the success from the previous year” said Brian Lee, who oversees the program for Sonoma County Water Agency.

It was a natural fit as Sonoma’s water agency is promoting efforts to conserve water and Falcon provides the most water-saving option of all – urinals that don’t require flushing because they don’t use any water at all. Moreover, the majority of those who signed up so far in 2012 are residents, so commercial properties are encouraged to participate in the program and install Falcon’s waterless urinals.

“This program shows how government incentives to go green are making a big difference in the community. We are working with many water providers to replicate and promote similar programs in their municipalities,” said Richard Sang, Director of Government Affairs at Falcon.
One such example is the Metropolitan Water District of Southern California and its Save Water, Save a Buck program, where customers can save up to $500 per urinal when replacing water-guzzling urinals with waterless ones. MWD covers 26 member water agencies, and its program is available everywhere from Oxnard and San Diego to Riverside.

Since the beginning of Sonoma’s program, Falcon has accounted for most of the waterless urinals installed. That number is expected to grow with increased interest in conservation and Falcon’s growing market share in waterless urinals. With each Falcon urinal saving an average of up to 40,000 gallons of water per year, businesses can reduce both their water and sewer costs by installing waterless urinals. This direct install program provides immediate savings to the customer with no up-front costs. As an added benefit, the program supports the local economy by putting plumbers to work.
The High Efficiency Fixture Direct-Install Program works as follows. Eligible properties apply and are selected on a first come, first served basis. They can choose a plumber from a list of participating contractors to perform the retrofits. Urinal retrofits are typically completed in a couple of hours and will not disrupt customer operations. The selected plumbing contractor purchases the fixtures from the approved list of vendors that include Falcon, install them for free and get reimbursement from the water agency. As a result, there are no out-of-pocket expenses to the customer with typical existing plumbing.

Waterless Urinal Leader Partners With LifeChange to Promote Water Crisis

LOS ANGELES, July 24, 2012 – Falcon Waterfree Technologies has partnered with LifeCHANGE Leadership Programs (co-created by Days of our Lives actress, Arianne Zucker) and the nonprofit, The Thirst Project, to sponsor an episodic internet broadcast that brings awareness to the clean water crisis. As a part of the project that was filmed in Africa, Falcon recently installed the first series of waterfree urinals in a business facility in Johannesburg which is anticipated to save up to 80,000 gallons of water a year.
“Waterless urinals are perfect for our project because they save the most important resource that many South Africans lack – water. We’re excited to partner with Falcon to bring a positive change to a community where these urinals can make a real difference in their lives,” said Zucker of LifeCHANGE.
In June, LifeCHANGE travelled to South Africa where it worked in collaboration with Africa Rising, an organization founded by Ndaba Mandela and Kweku Mandela Amuah, the grandsons of Nobel Peace Prize Winner Nelson Mandela, to enroll two young adults from the US and two young adults from South Africa in their leadership program. The participants travelled to Swaziland, where The Thirst Project is based, to learn more about the problem of access to clean water, how it affects the population and how the charity is addressing the issue.
Falcon already distributes its waterless urinals in Africa through The Good Earth, a local distributor, and their participation helps bring attention to the issue of clean water access in the most impoverished parts of South Africa.
“It was a natural fit for us – our products save water and these are communities where water is precious. It’s a great cause for which we as a company feel very strongly,” said Marc Nathanson, Falcon’s Chairman and Chief Executive Officer.
